Columbia Gas of Virginia, Inc. (referred to as the “Company”, “we”, “our” or “us”) respects your privacy and is committed to protecting it as described in this Privacy Notice. This Privacy Notice describes our privacy practices including the types of information we may collect about you and how we may use, maintain, disclose, and otherwise process such information.
This Privacy Notice applies to information we collect, including:
- through our Website (our websites, mobile applications, and the related functions and services such as the chat feature are collectively referenced as the “Website”);
- in email, telephone, and other electronic messaging between you and the Company through any medium;
- in person; or
- otherwise related to the provision of services to you.
However, this Privacy Notice does not apply to:
- Personal data we collect about you when you are acting in a commercial or employment context with us;
- Information we collect about you that has been lawfully made available through government records or to the general public through widely distributed media (or by you or another person to whom you disclosed the information) unless you restricted that information to a specific audience; or
- Information that has been deidentified and cannot reasonably be linked to an identified or identifiable consumer, or a device linked to that consumer.
Please read this Privacy Notice carefully to understand our privacy practices regarding your Personal Data and how we will treat it. By using the Website, our systems, or services, you acknowledge and consent to this Privacy Notice and our practices. This Privacy Notice may change from time to time (see Changes to Our Privacy Notice). Any dispute related to this Privacy Notice will be governed by our Terms of Use.
Maintaining the confidentiality of your Personal Data is important to us and the Company takes steps to protect it from public disclosure. Note, however, no safeguards can guarantee complete security or privacy of your Personal Data.
Information We Collect About You and How We Collect It
Throughout this Privacy Notice, the term “Personal Data” means any information that is linked or reasonably linkable to an identified or identifiable consumer. However, Personal Data does not include any de-identified or aggregated information or publicly available information.
Generally
We collect Personal Data through a variety of sources including directly from you when you provide it to us (e.g., email, telephone, website, in-person, other electronic messaging, etc.), automatically as you use our Website, and from third parties, for example, our business partners.
Information You Provide to Us
While we do not require you to provide Personal Data to navigate our Website, we must collect certain Personal Data if you choose to use our Services. We collect and process the following categories of Personal Data about consumers:
- Identifiers, including name, email address, service address, mailing address, date of birth, telephone number, and other similar identifiers. In order to register for certain services, we may also collect additional information, such as: social security number, driver’s license number, state identification card number, or passport number.
- Utility Service and Usage data We also may maintain information such as utility account number and associated property and service information, such as usage history and household data. If you sign up for one of our online payment methods, we may require you to provide your bank account numbers and other financial information in order to process payment.
- Internet or other similar network activity, such as information regarding a consumer’s interaction with our Website, including through the use of cookies (as further described in the Information We Collect Through Automatic Data Collection Technologies).
- Sensitive Personal Data, in limited circumstances, we may also collect sensitive Personal Data, such as health conditions, racial or ethnic origin, or citizenship or immigration status, if you voluntarily provide that information in connection with a survey, account registration, or other interaction with us in order to receive or maintain services. We will not process your sensitive Personal Data without your consent.
By voluntarily submitting a telephone number to us you agree that a representative of the Company can contact you at the number(s) you provide, potentially using autodialers or other automated technology (including texts/SMS messaging) or an artificial voice and/or pre-recorded messages. You agree to advise the Company when you longer use the telephone number(s) previously provided to the Company. The Company does not use texts/SMS messaging to send marketing messages. You may revoke this consent at any time by following the Company's opt-out instructions. However, please note, you may not opt-out of receiving certain emergency communications.
We may use artificial intelligence (“AI”) technologies to help operate, analyze, and improve certain features and functions of our Website, services, and customer services.
Our interactive Chatbot feature is designed to assist you with inquiries and provide customer support. Please be aware that when you engage with the Chatbot, the information you provide, such as your name, email address, and any other details you choose to share, may be collected, transcribed, recorded, and transmitted to our third-party Chatbot service provider to facilitate the functionality of this feature. By using the Chatbot, you consent to the collection, transcription, recording, and use of your communications by our third-party Chatbot provider.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain Personal Data about your interaction with our Website, including:
- Details of your visits to, and use of, our Website, such as the web request, Internet Protocol (“IP”) address, device and mobile ad identifiers, browser information, interaction with the sites, pages viewed, app usage, and other such information; we may collect similar information from emails you receive from us, which help us track which emails are opened and which links are clicked by recipients.
The technologies we use for this automatic data collection may include:
- Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer.
Our Website may use both session cookies (which expire when you close your browser) and persistent cookies (which remain on your device until deleted or expire).
You may reject non-essential cookies through our cookie consent manager, which you may access by clicking the “Cookie Preferences” link on the bottom of any page of our Website. You may also set your browser to refuse all or some browser cookies. However, if you do not consent to our use of cookies you may be unable to access certain parts of our Website. - Web Beacons. Pages of our Website and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company for example, to count users who have visited those pages or screens or opened an email and for other related Website statistics (for example, recording the popularity of certain Website content and verifying system and server integrity).
By allowing NON-ESSENTIAL cookies and RELATED TECHNOLOGIES, you hereby consent to our recording and disclosure to third-party cookie providers of your use of the Website or other communications you may have with our Website.
The information we collect automatically may include Personal Data, or we may maintain it or associate it with Personal Data we collect in other ways or receive from third parties. It helps us to improve our Website and to deliver a better
and more personalized service by enabling us to: (i) estimate our audience size and usage patterns; (ii) store information about your preferences; (iii) customize our Website according to your individual interests; (iv) speed up your searches; and
(v) recognize you when you return to our Website.
Information We Collect from Third Parties
We may supplement the information we collect from you with information from advertising and marketing partners, public
databases, data aggregators, and social media platforms, to the extent permitted by law and described in this Notice.
The Purposes for Which We Use the Personal Data We Collect
We may use Personal Data as permitted by law, including but not limited to, for the following business purposes:
- to provide, maintain, and manage utility services, process transactions and payments, and respond to your inquiries or requests;
- to administer and communicate with you about your account, including billing, service updates, orders, promotions, campaigns, programs, contests, sweepstakes, rebates, and rewards;
- to verify your identity, confirm the accuracy of information you provide, and process account changes;
- to support, troubleshoot, and secure our services, Websites, and internal systems, including preventing or investigating actual or potential fraud, detecting security incidents, and debugging technical issues;
- to personalize your experience and/or improve our services, Websites, and communications, including through quality control measures, surveys, and analytics;
- to send marketing and advertising materials from us, our affiliates, or strategic partners (where permitted), and to assess the effectiveness of our Websites, marketing campaigns, and service offerings;
- to provide important product safety information;
- to communicate with you about services, updates, promotions, programs, or events from us, our affiliates, or strategic partners (where permitted);
- to allow you to participate in programs, sweepstakes, social sharing (including live social media feeds), or other features that you choose to engage with;
- to conduct market research and develop new products, features, or service improvements;
- to maintain records and documentation for regulatory, contractual, or other legal purposes;
- to comply with applicable laws and legal processes, enforce our terms, respond to regulators or law enforcement, or protect the legal rights, safety, operations and property of the Company, its affiliates or others;
- to pursue available remedies or limit the damages that we or our affiliates may have or sustain;
- to document and maintain records as permitted by law, such as for regulatory or other record keeping purposes, and to process and document transactions;
- in any other way we describe when you provide the information, or to fulfill any other purpose for which it was collected; and
- for any other purpose with your consent or as required by law.
If you submit any Personal Data relating to other people, you represent that you have the authority to do so and to permit us to use such information in accordance with this Privacy Notice.
The Categories of Third Parties with Whom We May Share Personal Data
We may share all categories of your Personal Data with the following categories of third parties. The categories of Personal Data we share depends on the context, but may include identifiers, utility service and usage data, internet or other network activity, and, in limited circumstances, sensitive Personal Data. When we disclose Personal Data, we strive to enter into a contract that describes the purpose of the disclosure and requires the recipient to keep the information confidential and use it only as permitted.
- Affiliates, for the purposes described in this Privacy Notice;
- Business partners, Contractors, and Service Providers, to enable them to provide us with services such as website hosting, data analytics, marketing, payment processing, order fulfillment, infrastructure, IT, customer service, chatbot features, email delivery, SMS delivery, auditing, and similar services;
- Third-party cookie and other tracking technology providers, such as digital ad networks and cookie/tag/pixel providers, to measure and optimize ad performance across devices and services, and to provide analytics and advertising services to us;
- Third-party strategic partners with whom we may enter into an agreement to provide you with offers and services that may be of interest to you, where permitted by law;
- Transactional counterparties, in connection with any actual or potential reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our or a parent company’s business, assets or stock (including in connection with any bankruptcy or similar proceedings);
- Sweepstakes/promotions partners, in connection with certain promotions or sweepstakes you may choose to participate in; to the extent that the promotion’s rules concerning the treatment of your Personal Data are stricter than this Privacy Notice, the promotion’s rules apply;
- Other third-parties with whom we are legally required to share your Personal Data; and
- Government authorities, regulators, or law enforcement, to comply with applicable legal obligations or respond to requests.
Sale of Your Personal Data
We do not “sell” your Personal Data as defined under the Virginia Consumer Data Privacy Act. Under Virginia law, “sale” does not include sharing with service providers processing data on our behalf, our affiliates, or disclosures for providing services you request.
Your Rights and Choices
We provide customers with specific rights regarding their Personal Data. This section describes those rights and explains how to exercise them.
- Confirmation and Access. You have the right to confirm whether we process your Personal Data and to request access to that Personal Data we have collected and maintain about you except that we will not confirm or provide Personal Data that we believe would disclose our trade secrets. You may exercise this right as described below.
- Correction. You have the right to correct any inaccuracies in your Personal Data processed by us, taking into account the nature of the Personal Data and the purposes of the processing of your Personal Data. We may not be able to accommodate your request to change the Personal Data if we believe it would violate any law or legal requirement or cause the Personal Data or the information associated with the Personal Data to be incorrect.
- Deletion. You have the right to request that we delete certain Personal Data. We may not accommodate a request to erase your Personal Data if we believe the deletion would violate any law or legal requirement, such as for tax or other record keeping purposes, to maintain an active utility account, and to process transactions, or cause any information associated with the Personal Data to be incorrect.
- Obtain a Copy. To the extent you provide us with your Personal Data and to the extent we process the Personal Data by automated means, you have the right to request that we provide you a copy of, or access to, all or part of such Personal Data.
- Opt-Out of Certain Processing. You have the right to opt-out of
processing your Personal Data for the purposes of: (i) targeted advertising; (ii) the sale of your Personal Data; or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer. You may also
opt-out of the sharing of your Personal Data for marketing purposes.
Please note, however, the Company does not sell or process Personal Data for purposes of targeted advertising or profiling. - Non-Discrimination. We will not discriminate against you for exercising any of your rights outlined above. Unless permitted by law, we will not: (1) deny you goods or services; (2) charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties, or (3) provide you a different level or quality of goods or services for which you qualify.
How You Can Submit a Consumer Request
To exercise the rights described above, please submit a request (a “Consumer Request”) to us by either:
- Calling our Customer Contact Center at: 1-800-543-8911
- Completing the following Online Form
You may only make a request to exercise the above rights twice within a 12-month period. The request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with Personal Data if we cannot authenticate that the Personal Data that is the subject of your request relates to you through commercially reasonable efforts. In this case, we may request additional information, which we will only use to authenticate you. If your requests are manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee or refuse to act on the request.
Making a verifiable consumer request does not require you to create a password-protected, online account with us.
Response Timing and Format
We will generally process these requests within forty-five (45) days of receipt. If we require more time (up to 45 days), we will inform you of the reason and extension period in writing. If we cannot comply with or we decline to take action regarding your request, we will inform you within 45 days of receipt of your properly completed request, of our reasons for declining to take action and instructions for how to appeal the decision. Within 60 days of receipt of an appeal, we will inform you of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If the appeal is denied, we will provide you with information about how to contact the Attorney General to submit a complaint.
Children Under the Age of 18
While we may maintain energy-related educational materials suitable for parents or guardians to discuss with children under the age of 18, our Website is not intended for and should not be used by children under 18 years of age. No one under age 18 may provide any information to or on the Website. We do not knowingly collect Personal Data from children under 18.
Do Not Track Signals
Some web browsers permit you to broadcast a signal to Websites and online services indicating a preference that they “do not track” your online activities. However, there is no accepted standard for how a website or online service should respond to this signal, and at this time, we do not take any action in response to such a signal.
Changes to Our Privacy Notice
The Company may modify this Privacy Notice at any time. When we make changes to this Privacy Notice, we will post the updated Privacy Notice for thirty (30) days before becoming effective.
